Before you buy in Dubai, it is worth understanding exactly what you are acquiring. The ownership structure determines your rights, how the asset is registered, and what you can do with it.

Freehold vs leasehold

Freehold ownership gives you full, indefinite ownership of the property and the land it sits on, with the right to sell, lease, or pass it on. Foreign nationals can buy freehold in designated areas, which cover most of Dubai's popular investment communities. Leasehold grants the right to use a property for a long fixed term (commonly up to 99 years) without owning the land outright.

The title deed

For a completed (ready) property, ownership is evidenced by a Title Deed issued by the Dubai Land Department (DLD). It is the definitive proof of ownership and names the owner, property, and plot details. Always verify the title deed and that the seller is the registered owner before transacting.

Off-plan: Oqood

For off-plan property still under construction, your interest is recorded through the DLD's Oqood interim registration rather than a final title deed, which is issued on completion and handover. This is one reason off-plan carries different risks — see our off-plan due-diligence checklist.

Jointly Owned Property

Apartments and units in shared buildings fall under Jointly Owned Property rules, which is where service charges and the owners' association come in. Understanding these obligations is essential to calculating your true net return.

Ownership and residency

Ownership is separate from residency, though a qualifying freehold purchase can support the Golden Visa property route. Check which communities are freehold for foreign buyers before committing.
